Donkili ("we," "us," or "our") provides its music streaming services (the "Service") to you subject to the following Terms of Service ("TOS"). By using the Service in any way, you are agreeing to comply with the TOS.

Free and Premium Services

Donkili offers both free and premium subscription tiers. The free tier may include advertisements and limited features. The premium tier offers additional features such as ad-free listening, offline downloads, and higher audio quality.

Billing

By starting a Donkili Premium subscription, you agree to pay the monthly or annual subscription fee indicated at the time of purchase. Payments will be charged to your chosen payment method at confirmation of purchase and at the beginning of each subsequent subscription period.

Cancellation and Refunds

You may cancel your Donkili Premium subscription at any time. If you cancel, you will continue to have access to the Premium features until the end of your current billing period. We do not provide refunds for partial subscription periods.

5. User Conduct and Responsibilities

You agree not to engage in any of the following prohibited activities:

• Copying, distributing, or disclosing any part of the Service in any medium
• Using any automated system to access the Service
• Attempting to interfere with, compromise the system integrity, or decipher any transmissions
• Taking any action that imposes an unreasonable load on our infrastructure
• Uploading invalid data, viruses, worms, or other software agents
• Collecting or harvesting any personally identifiable information
• Using the Service for any illegal purpose or in violation of any laws
• Sharing your account credentials with others
• Circumventing any territorial restrictions applied by Donkili

The Donkili Service, including its design, features, and functionality, are owned by Donkili and are protected by copyright, trademark, and other laws.

Music and Audio Content

The music and audio content available through the Service is licensed to Donkili for distribution. User Content

You retain all rights to any content you create, upload, or post to the Service, such as playlists or comments. By making any user content available through the Service, you grant to Donkili a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, and display your content in connection with operating and providing the Service.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the account settings.

9. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DONKILI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DONKILI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
